Peculiarities of implementation of the Association Agreement between Ukraine and the European Union in the field of water transport

Abstract

The article investigates the problems of legal regulation of transport activities on the inland waterways of Ukraine and analyzes ways of adapting European legislation in the field of river transport with the legislation of Ukraine. Currently in Ukraine there is no legal framework regulating the implementation of river transpor-tation and the operation of port infrastructure. The purposeof the article is to analyze the implementation of the Association Agreement between Ukraine and the European Union and the significance of the adoption of the new Law for the legal regulation of transport activities and the development of navigation on the inland waterways of Ukraine. The author notes that the state policy in relation to river transport and the strategy for its implementation are now only being prescribed and approved in the prepared draft law on inland waterway  transport, which has been under development since 2015.The author notes that the settlement of the above-mentioned situation  requires a clear definition of the legal status of the river port, the delimitation of the func-tions of the river port in economic  activities and state control and supervision over the safety of navigation, determination of the status of the water area and territoryof the river port, consolidation at the legislative lev-el of legal relations with business entities of all forms of ownership. The article analyzes the advantages and disadvantages of the new Law.
