The issues of the development of the concept of protection of atmospheric air in context of interaction between international and national law

Abstract

The issue of protecting atmospheric air from pollution has reached a planetary scale. The problem of combating atmospheric air pollution is relevant in the general context of the study of urgent problems of legal and political support for the sustainable development of the state, society, and the economy of all countries of the world. Comprehensively analyzing the problem of the development of the concept of air protection, in the context of the interaction of international and national law, is an aim of the research. The goal setting predetermined the main directions and ideas of this research: the article analyzes acts of international law and national legislation as legal means of protecting atmospheric air from pollution; the state of legal regulation of the protection of atmospheric air from pollution in the Republic of Kazakhstan; emphasizes the need for a well-thought-out environmental policy based on strict measures of state and public control. On the basis of modern scientific methods and a wide range of foreign and domestic sources an analysis of the object under study was carried out; in the research process the system-structural method, the formal-legal method, the comparative legal method, the historical method, and the method of legal modeling were used. The authors of the article, based on a study of a complex of international, state, regional and local administrative, economic, technological, political and social measures to ensure socio-economic, cultural, historical, physical, chemical and biological comfort, necessary to preserve human health, suggest a model of legal regulation in protection of atmospheric air from pollution.
