The article reveals the process of the emergence and development of individual rights in the educational sphere as a category of the theory of human rights, discusses the main features of this institution. The purpose of the study is to identify the tendency of individual rights in the educational sphere and and the development stages of this institution in different historical eras. Using general and special research methods, the analysis and synthesis of historical material, to show the history of the development of human rights in the educational sphere in order to identify the basic laws of this institution development are carried out. From the point of view of the theory of human rights, the rights and duties of a person, public institutions and the state in the field of education. The study result is the implementation development of the periodization of the of individual rights in the educational sphere, consideration of the axiological aspects of human rights and the identification of the main patterns of development of the institution under study is. Individual rights in the educational sphere are considered as an inalienable right of every person and a necessary element of the human rights institution as a whole, its content is revealed by analyzing the current Kazakh, foreign and international law. The article systematizes the views of lawyers and sociologists about the law in the educational sphere.
